Native Americans and Medicaid

While Native Americans are a small percentage of the overall population, Massachusetts has several Indian tribes and elder lawyers may run into issues related to Native Americans from time to time. This page contains useful resources if an issue arises and provides a starting point for finding answers. The materials on this page cover nonfinancial eligibility standards for the Supplemental Nutrition Assistance Program (SNAP), health coverage benefits for American Indians and Alaska Natives from federally recognized tribes, income taxes of special concern to American Indians and those who are sole proprietors, and also provides some links to resources. The summary also covers certain exemptions to Medicaid estate recovery under Massachusetts regulations related to interests which American Indians may own, which exemptions are unique to them. These exemptions may apply to transfers from non-Indian transferors to American Indians, so may be relevant to an elder law or estate planning practice.
