Changes to Estate Recovery Law in Massachusetts as of September 2024
On September 6, 2024, Massachusetts Governor, Maura Healey, signed the Long-Term Care Bill (H.5033), An Act To Improve Quality And Oversight Of Long-Term Care. This bill included two sections that modified MassHealth Estate Recovery. Click Here to read about the changes.
Estate Recovery for MassHealth Members
If you receive MassHealth (the Medicaid program in Massachusetts), the Commonwealth may be able to recover against anything you own, such as a family home when you pass away. MassNAELA recommends that you contact one of our attorneys to provide advice on protecting your family home, or probating a loved one’s estate after they have passed away receiving MassHealth benefits.
