A bill was introduced in the Massachusetts House, “An Act Relative to Uniform Partition of Heirs Property”, H. 1744, filed 1/7/2023, to significantly revise the Massachusetts partition law to provide more notice and fairer procedures for protecting heirs’ interests in tenancy in common property subject to partition proceedings. This problem comes up for poorer and minority families who inherit by intestacy and are unaware of the ownership rights, often losing out on equity in inherited property when a partition sale is held.
